1. General Provisions

1.1. Individual Entrepreneur Andrey Vladimirovich Shkil (INN 561017656972, OGRNIP 325565800076010; the "Contractor") offers any person (the "User") to:

  • use cloud AI services in the BF Designer software, including free of charge within the monthly free tokens (clause 7.2);
  • take out the paid Pro plan (Section 5);
  • purchase internal BFT tokens

on the terms of this offer (the "Offer") and its "Pricing" appendix.

The Offer is addressed to individuals. For legal entities and individual entrepreneurs wishing to pay for the Pro plan or tokens on behalf of an organization, the Contractor, upon request to legal@blenderfamily.com, offers a separate contract and payment by invoice.

1.2. The BF Designer software itself is free. The right to use it is granted under the "License Agreement for the BF Designer Software" (the "License Agreement"). The Offer sets out the terms of the Pro plan, tokens and AI services.

1.3. How the Offer is accepted. The User accepts the Offer (acceptance):

  • upon purchase — by ticking the mandatory checkbox "I accept the public offer and have read the personal data processing policy" on the Payment Page and paying for the order (clause 3 of Article 438 of the Civil Code of the Russian Federation);
  • upon free use of AI services — by checking "I accept the Offer" in the welcome wizard at the first launch of the Software, or "I accept" in the window that the Software displays before the first cloud generation if the Offer has not yet been accepted.

1.4. The Software and AI services have "early access" status: features, the range of models and prices change, and errors and interruptions are possible.

1.5. Age. Only a person who has reached 18 years of age may take out the Pro plan, purchase tokens and use AI services; by accepting the Offer and paying for an order, the User confirms this. If it becomes known that the User is under 18, access to AI services and the Pro plan is terminated, and the fee for the current paid Pro term and for unused and unexpired purchased tokens is refunded in full upon a request from the legal representative (License Agreement, clause 1.6).

1.6. Personal data are processed in accordance with the "Personal Data Processing Policy" (the "Policy").

2. Definitions

  • Software — the BF Designer computer program for Windows (upon release of a macOS version, also for macOS).
  • Account — a record of the User on the Contractor's server, created using a mobile phone number (License Agreement, Section 5). The phone number is the Account identifier.
  • License key — the User's license key linked to the User's Account.
  • Bot — the Telegram bot @bfdesigner_bot: an optional channel for notifications and generations for Users who have linked Telegram to their Account. The Bot cannot be used to register, obtain a license key, pay for an order or manage the plan.
  • Basic plan — a free plan with no time limit: the entire Software, including local neural networks; cloud AI services within the free tokens (clause 7.2).
  • Pro plan — a paid plan: everything in Basic, plus online feedback, token purchases and 100 BFT at the start of each Paid Month (Section 5).
  • Launch Period — the early access period after the release of the Software with phone number registration, expected to last 2–3 months, during which Pro features are available to everyone free of charge (clause 5.1).
  • Paid Month — each month of the paid Pro term, counted from the start date of that term. If a month has no day with the same number as the day on which the term started, the Paid Month ends on the last day of that month.
  • Payment Page — the website pay.blenderfamily.com, which the User reaches via a personal link from the Software or signs in to with their phone number.
  • Robokassa — the payment acceptance service of ROBOKASSA LLC (clause 4.1).
  • Auto-renewal — automatic charging of the fee for the next Pro term with the User's consent (Section 6).
  • AI services — generation of images, video and audio (music, speech transcription, voice-over), responses of language models (the AI assistant "Alyosha", chat in the Bot) and voice dialogue by means of cloud neural networks. Generation of 3D models and locations may be added in the future.
  • Model — a specific neural network selected by the User. Provider — the company that owns a model. Aggregator — an intermediary through which the Contractor obtains access to models.
  • Request — the text (prompt), settings and uploaded materials (references, voice recordings) submitted for generation. Output — the material received from a model.
  • BFT token (token) — an internal unit of account used to pay for AI services. Balance — the number of tokens on the User's Account, shared between the Software and the Bot. Batch — the tokens of a single credit: one purchased package, 100 BFT for one Paid Month of Pro or one bonus credit.

3. How to Place an Order

3.1. An order is placed on the Payment Page. It can be reached via a personal link from the Software (the "Buy" button; the link is valid for 30 minutes) or by signing in to pay.blenderfamily.com with a phone number and confirmation code. Payment is always linked to the Account: the Payment Page shows the phone number with the middle digits masked and the last characters of the license key. The User checks them before payment.

3.2. On the Payment Page, the User selects a Pro term or a token package, specifies an e-mail address for the cash receipt and ticks the mandatory checkbox "I accept the public offer and have read the personal data processing policy". For Pro, the User may separately tick the "Renew automatically" checkbox (Section 6); it is unticked by default. Consent to marketing messages is a separate optional checkbox, unticked by default.

3.3. Provision. Pro and tokens are provided electronically and automatically after Robokassa notifies of a successful payment — usually within a minute; if the bank delays confirmation, immediately after confirmation. No physical delivery is made, and no delivery fee is charged.

3.4. If the payment fails, the order is not fulfilled and nothing is charged.

4. Payment and Receipts

4.1. Payments are accepted by ROBOKASSA LLC (INN 5047063929, OGRN 1055009302215), acting as a payment agent; the store is "BF Designer" and the payment website is pay.blenderfamily.com. The payment methods are MIR, Visa and Mastercard bank cards and the Faster Payments System (SBP); the specific set is shown on the Payment Page.

4.2. The User enters bank card details on Robokassa's page; they are processed only by Robokassa. The Contractor does not receive or store them. For auto-renewal, the Contractor stores only the number of the first payment in Robokassa.

4.3. Robokassa's commission is paid by the Contractor: the User pays exactly the price shown on the website. The User's payment obligation is deemed fulfilled when Robokassa has confirmed a successful payment.

4.4. A cash receipt for each payment, automatic charge and refund is generated by Robokassa's "Robocheki" service and sent to the e-mail address specified on the Payment Page. The receipt states: subject of settlement — service; method of settlement — full payment; tax system — simplified tax system ("income"); no VAT. The item name is "Package of N BFT — tokens for generations in BF Designer" or "BF Designer Pro plan, N months".

4.5. Prices are set out in the "Pricing" appendix in roubles. No VAT is charged: the Contractor applies the simplified taxation system.

5. Pro Plan

5.1. Launch Period. During the Launch Period, Pro features — online feedback, purchasing tokens and using them — are available to all Users free of charge; there is no subscription fee. The monthly 100 BFT are not credited during the Launch Period; the free tokens apply (clause 7.2). The Pro plan is introduced when the Launch Period ends. The Contractor announces the end of the Launch Period and the transition to the Basic and Pro plans in the Software and on the website at least 7 days in advance. Purchased tokens are retained on transition under the general rules (clause 7.4).

5.2. Terms and prices. Pro is taken out for 1, 3, 6 or 12 months. The price is proportional to the term; there are no discounts for a longer term or for the first payment. Prices are set out in the "Pricing" appendix.

5.3. Tokens with Pro. At the start of each Paid Month, 100 BFT are credited to the Balance: for the first month, immediately after payment; for subsequent months, on the same day of each following month or, if there is no such day in the month, on the last day of the month. When paying for several months, tokens are credited monthly rather than for the whole term at once. Each credit is a separate Batch valid for 12 months (clause 7.4).

5.4. End of Pro. 7 days before the end of the paid term the Software shows a warning, and 3 days before, the Contractor sends a reminder to the e-mail address specified at payment. After the term ends, the Software runs on the Basic plan: online feedback and token purchases are unavailable, and cloud AI services are available only within the free tokens. Purchased and Pro tokens are retained within the validity of their Batches (clause 7.4) and become available again after Pro is paid for; purchased tokens may be refunded in money at any time under Section 10. A job launched before the end of the term is completed, and its Output can be obtained.

5.5. Early payment. Paying for Pro before the current term ends extends it from the end date rather than from the payment date. Paid days are not lost.

6. Auto-renewal

6.1. How it is enabled. Auto-renewal is enabled only if the User has personally ticked the "Renew automatically" checkbox when paying for Pro; it is unticked by default. The amount and frequency of subsequent charges and the method of cancellation are shown next to the checkbox. The auto-renewal terms are set out in the document "Consent to Auto-Renewal of the BF Designer Pro Plan". The Contractor stores confirmation of consent: date and time, IP address, term, amount and frequency, the version of the consent text and the number of the first payment. Auto-renewal is available only for payment by bank card; when paying via the Faster Payments System, Pro is paid once.

6.2. Charge. When the paid term ends, the fee for the next term of the same length is automatically charged to the card with which the User paid for Pro, at the price in effect on the date of the charge.

6.3. Reminder. 3 days before each charge, the Contractor sends the date and amount of the charge to the e-mail address specified at payment and shows them in the Software.

6.4. Price change. If the price that will apply to the charge has changed, the Contractor notifies the User of the new price by e-mail and in the Software at least 7 days before the charge. A User who does not agree with the new price may cancel auto-renewal.

6.5. After a charge, the Contractor informs the User in the Software and by e-mail of the date until which Pro has been extended. The receipt is sent by e-mail.

6.6. If a charge fails, the Contractor retries it 1 day and 3 days after the end of the paid term and notifies the User of each failed attempt in the Software and by e-mail. While attempts are ongoing, Pro remains active. After the third failed attempt, auto-renewal is disabled, Pro ends, and no debt arises. Pro can be resumed by making a new payment.

6.7. Cancellation. The User may cancel auto-renewal at any time with a single click — in the Software (Settings → License) or on pay.blenderfamily.com — or by writing to support@blenderfamily.com. After cancellation, no further charges are made. The paid term runs until its end. The Contractor keeps a record of each cancellation: time, method and by whom it was made.

6.8. If the User has stopped using the card or account from which auto-renewal is charged, no charges are made to it.

7. Tokens

7.1. Nature of tokens. A BFT token is an internal unit of account recording prepayment for AI services. A token is not money, electronic money, a security, a digital currency or a digital financial asset, cannot be exchanged for any of them and cannot be transferred to other users. In the Software, prices are shown only in tokens.

7.2. Free tokens — 5 BFT per month. Every User on any plan, including Basic, receives them. Free tokens do not accumulate: upon registration of the Account and then at the start of each calendar month, their remaining amount is topped up to 5 BFT (for example, if 2 remain, 3 are credited). Free tokens are a bonus: they are not refunded in money and are not included in refund calculations. The right to free tokens is limited to one Account per phone number and per computer; creating several Accounts to receive them repeatedly is not allowed.

7.3. Other ways to obtain tokens:

  • with the Pro plan — 100 BFT at the start of each Paid Month (clause 5.3);
  • purchase a package on the Payment Page — only with an active Pro plan, and during the Launch Period on any plan. Packages and prices are set out in the "Pricing" appendix, including packages for an arbitrary amount at the rate of 1 BFT = 3 ₽. Purchasing a package is payment for the service of providing access to AI services in the amount of the purchased tokens; the service is deemed rendered when the tokens are credited to the Balance;
  • bonus tokens — the Contractor may credit them free of charge at its own discretion: to students, as bonuses and in other cases.

7.4. Tokens are valid for 12 months. Each Batch of purchased, Pro and bonus tokens is valid for 12 months from the date of crediting. When this period expires, the unused remainder of the Batch expires and is not refunded, including in money. A Batch's validity does not depend on the plan: after Pro ends, tokens are retained, but within the same 12 months. The Contractor may, but is not obliged to, remind the User that tokens are about to expire.

7.5. Order of charging. Free tokens are charged first, then purchased, Pro and bonus tokens — by Batch, starting with the oldest. This rule also determines which purchased tokens remain unused for refund purposes (clause 10.2). On the Basic plan, only free tokens are spent; other Batches are kept until they expire and become available again when the User returns to Pro.

7.6. Free limit. The basic language model may operate within a free limit without charging tokens. The size of the limit is set, and may be changed, by the Contractor.

7.7. When the Account is deleted at the User's request, the Balance ceases to exist; before deletion, the User may obtain a refund for unused and unexpired purchased tokens under Section 10.

7.8. Voluntary donations to the Blender Family channel are not related to BF Designer and are not governed by the Offer.

8. AI Services

8.1. A Request follows this path: the Software or the Bot → the Contractor's server (Russia) → the RouterAI aggregator (Inter LLC, INN 7017351722; backup channel — the Timeweb AI service (TIMEWEB.CLOUD LLC, Russia)) → the Provider of the selected model. Providers include OpenAI, Anthropic, Google, xAI, Black Forest Labs, ByteDance, Kuaishou, Krea, Recraft, MiniMax, Microsoft, NVIDIA, Zhipu AI and others. The aggregator may send a Request to the Provider directly or through an intermediary cloud platform (Microsoft Azure, Amazon Bedrock, Google Vertex AI, DeepInfra and others). The current list of models, Providers and Request recipients is available at license.blenderfamily.com/legal/models.

8.2. Providers' servers may be located outside Russia. The contents of a Request are transmitted to the Provider for generation. The User's identifiers (phone number, Telegram ID, e-mail, license key) are not transmitted to Providers. The terms of certain Providers allow the contents of Requests to be used to improve their models; such Providers are marked on the page license.blenderfamily.com/legal/models.

8.3. The Contractor does not control the operation of Providers. The availability, speed and quality of models depend on the Providers and are not guaranteed; models may appear, change and disappear. In the Bot, the Output is delivered via Telegram, which is a foreign service.

8.4. The User is responsible for the contents of a Request. The User decides whether to include their own photos, voice and other information about themselves in a Request. Images, voices and other personal data of other people may be included only with their consent; the User is responsible for their presence in a Request and for obtaining consent. The Contractor may reject a Request or restrict access to AI services for a breach of this clause (clause 13.5).

9. Generation Prices and Token Charges

9.1. Generation prices are shown in tokens in the interface of the Software and the Bot. The Contractor may change prices. The number of tokens on the Balance does not change as a result, but the same number of tokens may then buy a different number of generations.

9.2. Images, video and audio. The price is shown before launch and is recalculated when settings are changed. On launch, the tokens are reserved. After generation, the actual cost is charged — no more than the reserved amount — and the difference is returned to the Balance.

9.3. Language models (assistant, chat). The cost of a response depends on the length of the request, the context and the response, and therefore becomes known only after the response and is charged on an actual basis. For each language model, the page license.blenderfamily.com/legal/models states the minimum charge per response and the approximate cost of typical responses — a short one and a detailed one. The actual charge is shown after each response. The basic model does not debit tokens within the free limit (clause 7.6). "Reasoning" models may cost dozens of times more than regular models for the same question.

9.4. Voice dialogue is charged on an actual basis after the response. If the connection is interrupted, the cost of the part already generated is charged.

9.5. Failed generation and moderation refusal. If a generation does not take place — due to an error, unavailability of the Provider, an empty Output or a refusal by the Provider under its moderation rules — no tokens are charged, and the reserved tokens are automatically returned to the Balance, to the same Batches.

9.6. If there are not enough available tokens on the Balance, the generation does not start; the Software and the Bot show how many tokens are needed.

10. Refunds

10.1. Cancelling Pro. The User may cancel Pro at any time. The current Paid Month is deemed provided: its tokens have already been credited and access has been granted. For each unused full Paid Month, the amount paid divided by the number of months in the paid term is refunded. Example: Pro for 12 months at 6,000 ₽, cancelled in the 4th month — 6,000 × 8/12 = 4,000 ₽ is refunded. Pro remains active until the end of the current Paid Month, and auto-renewal is disabled. To cancel only auto-renewal while keeping the paid term, see clause 6.7.

10.2. Tokens. Only tokens purchased as a package that are unused and have not expired are refunded in money — at the purchase price, at any time, including after Pro ends. Which tokens remain unused is determined under clause 7.5. Free, bonus, Pro and expired tokens are not refunded in money. Tokens returned to the Balance under clause 9.5 remain on the Balance.

10.3. Erroneous charges — a double charge or a charge after auto-renewal has been cancelled — are refunded in full.

10.4. How to obtain a refund. A request is sent to support@blenderfamily.com or from the Support section of the Software. The Contractor refunds the money within 10 days of receiving the request via Robokassa, using the same method by which the payment was made; a cash receipt is generated for the refund. The time it takes for the money to reach the card depends on the bank and may be up to 30 days.

10.5. After a refund, the corresponding tokens are debited from the Balance.

These rules are summarized on the "Refund and Delivery Terms" page.

11. Project Closure

11.1. If the Contractor stops providing AI services and selling the Pro plan, it notifies Users in the Software, by e-mail (if provided) and in the Bot (if linked) at least 30 days in advance. Auto-renewal is disabled, and no new charges are made. Tokens may be used during this period.

11.2. The fee for unused full months of Pro and the remainder of unused and unexpired purchased tokens are refunded upon a request submitted within 60 days after the notice, under the rules of Section 10. The Software continues to work under the rules of the License Agreement (clause 11.3).

12. Rights to Outputs

12.1. Rights to Outputs belong to the User to the extent permitted by the terms of the model's Provider and by law. The Contractor claims no rights to the User's Requests and Outputs.

12.2. Under Russian law, a work is recognized as the result of a human being's creative effort. An Output created by a neural network without the User's creative contribution may not be protected by copyright.

12.3. The Contractor does not guarantee that an Output is unique: other users may obtain a similar one.

12.4. The terms and usage policies of Providers apply in addition to the Offer. Links to them are provided at license.blenderfamily.com/legal/models.

13. User Materials and Prohibited Content

13.1. The User is responsible for the materials the User uploads in a Request: other people's images and videos, images of people, voices, trademarks, recognizable characters. A person's image may be used only with that person's consent (Article 152.1 of the Civil Code of the Russian Federation).

13.2. By including other people's personal data in a Request (clause 8.4), the User warrants that they have obtained those people's consent, including to transmission to Providers outside Russia, and is liable for the consequences to those people and to the Contractor.

13.3. It is prohibited to use AI services to create:

  • images, video and voices of real people without their consent, including deepfakes;
  • sexual material involving minors;
  • extremist and terrorist material, or calls for violence;
  • material for fraud and deception;
  • material that infringes the rights of others, including intellectual property rights;
  • any other material prohibited by law.

13.4. The rules of Providers apply in addition to these rules: a Provider may refuse a generation under its own moderation rules (clause 9.5).

13.5. In the event of a breach of clause 8.4 or Section 13, the Contractor may refuse a generation and suspend the User's access to AI services, notifying the User in the Software. In this case, unused and unexpired purchased tokens are refunded in money upon request (Section 10).

14. Labelling of AI-Generated Content

14.1. The Contractor does not remove from Outputs the service labels added by the model's Provider.

14.2. When publishing Outputs, the User is responsible for complying with the legal requirements on labelling content created using artificial intelligence.

15. What Is Stored on the Server

15.1. The finished Output is stored for 2 hours, so that it can be retrieved again if the connection is interrupted, and is then deleted. References are deleted 2 hours after the job is completed; if the job gets stuck, after 24 hours.

15.2. The prompt and parameters of a job are stored for no longer than 30 days, to handle requests and disputed charges, and are then deleted; for images, the prompt is not stored on the server. The model, date and cost of the job are stored for 5 years as settlement data. Images attached to a generation card in the Bot are deleted after 2 hours.

15.3. The history of dialogues with language models in the Bot is stored so that the conversation can be continued, and is deleted automatically 30 days after the last message. With each model response, the entire conversation within the model's limit is transmitted to the Provider anew.

15.4. Details are set out in the Policy.

16. Liability

16.1. AI services are provided "as is". Responses of language models may be inaccurate or incomplete and do not constitute professional advice. The User checks Outputs before using them.

16.2. The Contractor is not liable for disruptions caused by Providers, the aggregator, Telegram, Robokassa, blocking or communication failures. In such cases, tokens for generations that did not take place are returned under clause 9.5.

16.3. To the extent that the law permits limitation of liability, the Contractor's liability for a specific generation is limited to the cost of the tokens charged for it. This limitation does not apply where the law does not permit it.

17. Amendments to the Offer

17.1. The Contractor may amend the Offer, the plans and the range of models by publishing a new version at license.blenderfamily.com/legal/ and notifying Users in the Software and on the website; notice of material changes is given at least 7 days in advance. A price change for auto-renewal is governed by clause 6.4.

17.2. The new version applies to orders placed after its publication. Pro terms already paid for retain their terms. Purchased tokens retain their refund procedure; generation prices are determined under clause 9.1. A User who does not agree with the new version may cancel Pro and receive a refund for unused and unexpired purchased tokens under Section 10.

17.3. The Contractor keeps an acceptance log: the document and its version, the Account (phone number) and license key, date and time, source (the Software or the Payment Page), the IP address and information about the browser or the Software, the payment number and the version of the checkbox text.

17.4. Transition to token validity. For tokens credited before version 1.2 of the Offer takes effect, the 12-month period (clause 7.4) is counted from the date this version takes effect.

18. Disputes, Governing Law, Language

18.1. The law of the Russian Federation applies.

18.2. Before going to court, a claim must be sent to legal@blenderfamily.com; the time limit for a response is 10 days.

18.3. Disputes are heard by the court at the Contractor's location. A User who is a consumer may bring an action in the court at their place of residence or stay.

18.4. The Offer is drawn up in Russian; the English translation is provided for convenience, and in case of discrepancy the Russian text prevails.
